McAlpin Tanner Marcotte successful in obtaining dismissal for Fraud on the Tribunal in Jones Act case

Partner Daniel Marcotte successfully argued for the dismissal of a crewmember claim proceeding in arbitration. Here, on behalf of the Respondent, a spa concierge aboard a major cruise line, Mr. Marcotte was able to provide clear and convincing evidence that the crewmember attempted to perpetrate fraud on the Respondent and the Tribunal. The Tribunal thus found that the crewmember’s fraud was blatant and uncontroverted and further went to the core issues that the Tribunal was empaneled to decide. The Tribunal agreed with Respondent and dismissed the crewmember’s claim.
